1. About These Terms

• These Terms of Use set out the conditions for using Impossible Commute (Japanese title: 出社無理ゲー; the "App"), an iPhone application provided by Yuya Sato (the "Developer").
• The license to use the App is governed by Apple's Licensed Application End User License Agreement (Standard EULA), which applies automatically to every user who obtains the App through the App Store. These Terms supplement that agreement. If these Terms conflict with Apple's Standard EULA, the Standard EULA prevails.
• These Terms are an agreement between you and the Developer. Apple is not a party to these Terms and has no responsibility for providing, maintaining, or supporting the App. However, Apple and its subsidiaries may be third-party beneficiaries of these Terms as provided in Apple's Standard EULA.
• By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App and delete it from your device.
• If you are a minor, please use the App with the consent of a parent or guardian.

2. What the App Is

• The App is a single-player side-scrolling action game in which you guide a commuting office worker toward the office.
• It runs on iPhone only, in landscape orientation only, and requires iOS 16.0 or later. iPad and other devices are not supported.
• There are no user accounts, no sign-in, no online multiplayer, no leaderboards, no chat, and no way to post content to other users.
• An internet connection is not required to play. A connection is used only when you share an image through another app and when you open the X link on the title screen.
• The App displays no advertising.

3. Price

• The App is free. There are no in-app purchases, no subscriptions, no consumable items, and no donations or tipping.
• Accordingly, the Developer receives no payment from you for the App, and no refunds arise.
• If any paid feature is introduced in the future, its terms and price will be as shown on the App Store and governed by Apple's rules. All purchases and refunds made through the App Store are handled entirely by Apple; the Developer cannot decide whether a refund is granted and cannot process one on your behalf.

4. Daily Play Limit

The App limits how many times you can play per day. The current rules are:

• You can start up to three games per day. The number remaining is shown on the title screen.
• The count resets to three at 5:00 AM. The reset is based on your device's time zone, so if you are outside Japan the cutoff is 5:00 AM in your own location.
• Choosing "Retry" after a game over does not use up a play. Returning to the title screen from the pause or death screen does use one play the next time you start.
• Plays cannot be purchased, restored by watching an advertisement, or granted as compensation for a defect.
• Please do not circumvent this limit, for example by changing your device's date or time settings.
• The number of plays and the reset time may change without notice as part of game balancing.

5. Saved Game Data

• Your records — total deaths, best time, clear status, and remaining plays for the day — are stored only on your iPhone. They are never stored on any server operated by the Developer. See the Privacy Policy for details.
• The App does not sync data through iCloud or any other service, so data cannot be transferred to a new device.
• Deleting the App erases these records permanently. The Developer cannot recover, transfer, or reissue them.
• If you use your device's backup feature, records may be restored from a backup. That is a function of iOS and is not guaranteed by the Developer.

6. Sharing

• Tapping "Share" on the death or clear screen generates an image containing your results on your iPhone and opens the standard iOS share sheet.
• The image contains the character artwork, the death line or clear time, your total death count, the game title, and the X account name @damerimankun. The accompanying post text also contains that account name and a hashtag.
• The image and post text are never sent to the Developer. They go only to the app or recipient you select in the share sheet.
• Once shared, the information is handled under the terms and privacy policy of the receiving service. Anything you post publicly on social media can be viewed, saved, and quoted by others.
• The Developer may highlight publicly posted content using a service's own quote or repost features. The Developer will not copy or modify your posts outside of those features.

7. Prohibited Conduct

When using the App, you must not:

• use it for any purpose that violates applicable law;
• copy, modify, adapt, disassemble, decompile, reverse engineer, redistribute, sell, or lend the App;
• circumvent the daily play limit in Section 4, including by altering saved data or the App itself, or by changing your device's clock;
• interfere with the provision of the App, or cause a nuisance to the Developer or other users; or
• infringe the copyrights, trademarks, or other rights of the Developer or any third party.

8. Intellectual Property

• Copyright and other rights in the App's program code, screen design, the character "Damerimankun," illustrations, sound effects and music, text, icons, and names belong to the Developer or the respective rights holders.
• You may freely use images generated by the App's share feature to post on social media as an individual. You may not use them commercially, use them to promote anything unrelated to the App, or alter and distribute them in a way that suggests the Developer created the altered version.
• The Developer claims no rights in the records saved on your device.

9. Disclaimers and Limitation of Liability

• The App is provided "as is." The Developer does not warrant that it will suit any particular purpose, that it is free of defects, or that it will be provided without interruption.
• To the fullest extent permitted by law, the Developer is not liable for the following. This does not apply where the Developer has acted intentionally or with gross negligence.
  • the difficulty of the game, inability to progress, or failure to achieve a particular result or completion;
  • loss or corruption of saved data, or the inability to transfer it;
  • malfunctions caused by device failure, device settings, OS updates, or other aspects of your environment;
  • anything that occurs on a service to which you share content, or the contents of external links such as X; and
  • any damage arising to you or a third party in connection with the above.
• Where the Japanese Consumer Contract Act or other mandatory law does not permit a complete exclusion of liability, the Developer remains liable to the extent required by that law.
• The App is a work of fiction. It does not provide advice about actual commuting, road safety, working conditions, or any other real-world matter.

10. Changes to the App and Discontinuation

• The Developer may change, add to, or remove stage layouts, difficulty, the play limit, on-screen content, and other elements without prior notice.
• The Developer may discontinue the App. After discontinuation, the App will no longer be distributed on the App Store and defects will no longer be fixed.
• Sections 5, 8, 9, and 12 of these Terms continue to apply to any copy of the App already installed on your device after discontinuation.

11. Changes to These Terms

• The Developer may revise these Terms as needed.
• Revised Terms take effect when posted on this page. For significant changes, the "Last updated" date will be revised and notice will be given, for example in the App Store "What's New" section.
• Continuing to use the App after a revision constitutes acceptance of the revised Terms.

12. Governing Law

• These Terms are governed by and construed in accordance with the laws of Japan.
• If you are a consumer residing outside Japan, this does not deprive you of the protection of any mandatory consumer-protection provisions of the law of your country of residence.
